Several people in my house/street have a similar problem. Can our cases be combined?

Together you are stronger! It is possible to combine your cases. For us to combine multiple matters and cases it is necessary that everyone who wants to participate is known to us. Therefore all your roommates/neighbours have to fill out the ‘Submit your case’-form. Huurteams Nijmegen preferably handles comparable questions simultaneously. 

In general Huurteams Nijmegen works for free and uses the following methods:

  1. Submit your case: After submitting your case through our website, we will contact you. If it is useful we will plan an appointment to see and inspect your home.
  2. Inspecting your home: During the visit we will measure your home to determine the fair rental price and/or to discuss maintenance problems and/or your service costs, depending on your case. 
  3. Contacting your landlord: With your permission we will contact your landlord and try to reach an agreement about how to solve the problem(s). We strive for a solutions that works best for your situation, so we take in consideration how you feel about different outcomes of the case(s).
  4. Procedure with the Rent Tribunal (Huurcommissie): If your landlord will not come to an agreement with us, we can start a procedure with the Rent Tribunal. Huurteams Nijmegen will disburse the handling fee of €25 in advance. If we win the case no (service)costs will be charged. If we lose the case, we will charge you  the €25 handeling fee. 
  5. Next steps and (situational) collection procedure : After the verdict of the Rent Tribunal your case can be closed, depending on your situation. If necessary Huurteams Nijmegen will assit you with the next possible steps. This is usually needed with cases in which the landlord needs to pay you money, but refuses to do so. In some cases we can help collect. Please note the collection procedure activities is intensive and expensive. To cover a part of our costs we ask a depostit (up to €125) in advance and a percentage of the claim on the landlord. Keep in mind that we are a non-profit organisation, and are using the charged amounts to cover our expenses. We do not charge costs for our regular activities

Can I combine multiple complaints about my home?

On our webform (click the button submit case) you can state more complaints at the same time about your rental home. These complaints will be attented to at the same time. Depending on the complaints Huurteams Nijmegen will provide in the procedures that need to be followed.

Do you wish to assess your initial rental price and do you also have maintenance problems?

  • Living in your rental home for less than six months?
    The Rent Tribunal (Huurcommissie) can attend to this cases at the same time.
  • Living in your rental home for more than six months?
    If your a living in your rental home for more than six months, the procedures will be submitted seperately. Huurteams Nijmegen can attend to them at the same time, but they will be separate cases at the Rental Tribunal.

I moved, can I still start a case?

Huurteams Nijmegen offers different services for a variety of legal proceedings. Read more about them here [link]. Only under certain conditions it is possible to start (and complete) a case at the Rental Tribunal (Huurcommissie) after you have moved:

  • Initial Rental price:
    If you rented your home less than six months and the rent was below the deregulation limit, it is possible to start a case about your rental prince. It’s important that Huurteams Nijmegen can access your former home, to inspect and take measurements.This is also the case for the inspector of the Rental Tribunal if we have to start a procedure. If it is possible to take measurements for both us and the Rental Tribunal, we can start a case.
    NB: Both the visit of Huurteams Nijmegen and that of the inspecor will be scheduled. We only need acces at these moments. You do not need a permanent acces tot the lot, the help/approval of the current resident will do.
  • Lowering of the Rental Price
    When you start a procedure with the Rental Tribunal after moving, the Rental Tribunal can only lower your rent for future months, so that they force your landlord to fix things. Therefore it is not possible to start a procedure after moving, so you can not receive a compensation. There is one exception (see above): if you lived six months or less in your rental home, the Rental Tribunal can assess the intital rent and lower the whole rent for the period of living there. The landlord will have to pay back the overpaid rent.
  • Service costs:
    With service costs procedures it is possible to start a case after you have moved out of your home. Usually you do not do not obtain a statement directly after moving out, since it is only beïng settled once a year. You can obtain the settlement when the other tenants in the house (once a year) obtain it. It’s important that your landlord has your new address to send the settlement to. When you payed more for service costs in advance than your landlord payed for providing services, it is possible to start a case. .
  • Maintenance:

    When it comes to big maintenance of a rental, the responsibility lies with the landlord. For example, he or she is responsible for taking care of repairing damages such as leakage, for maintenance of frames, replacing locks and doors of renovation of the facades. But also reparations such as replacing a broken heater, showerhead or toilet seat are for the landlord’s account. Small and daily maintenance, along with the repair of damages that you caused yourself, are on your account as the tenant. If the landlord also takes care of these small daily repairs, he or she is allowed to charge you in the form of service costs. However, this is only the case when you and your landlord discussed and agreed on this explicitly.

Is it possible to submit a case and start a procedure?

It is always possible to submit your case to Huurteams Nijmegen. We provide in a wide range of services. Most of our services are related to procedures at the Rent Tribunal (Huurcommissie). Click here to read more about the Rent Tribunal. Our services consist of (but are not excluded to):

After you have submitted your case we will assist you with the next steps. 

Please note: In the first six months after you signed your rental agreement, the reasonability of the initial rental price can be assessed and you can reclaim the overpaid amount of rent from the moment you initiated the procedure. This is not possible if six months have already passed.
